Christian Burial Policy
Catholic Cemeteries serve the Catholic Community its care of the dead. Bound by ecclesiastical law and civil regulations the Catholic Cemeteries of the Diocese of San Jose requires a Christian Burial Permit, signed by a Catholic priest or deacon for all remains to be interred. Ordinarily, only the following may be buried in the Catholic Cemeteries:
  • Catholics
  • Non-Catholic Family of Catholics (e.g., non-Catholic spouse, children, parents of a Catholic)
  • Non-Catholics with a demonstrable connection to the Catholic community (Ex: teachers at Catholic schools, non-Catholics who attended Catholic schools, non-Catholic employees of the diocese or its schools).
  • Family members of non-Catholics who have been buried here prior to this policy.
  • Non-Catholics who have purchased burial property prior to this policy.
  • Other Christians, by exception (e.g., a Presbyterian minister calls to ask permission for his parishioner who wishes to be buried in a religious cemetery).
It is the responsibility of the family or representative of the decedent to provide acceptable information that the decedent meets one of the above qualifications. If the decedent or family is non-Catholic, the family must meet with a Catholic priest or deacon to sign the Christian Burial Permit prior to interment.

Catholics are to contact their own parish priest regarding a Christian Burial Permit.

All decedents will have some relationship to the Catholic community. Any exception to this will require the approval of the Director of Cemeteries.
